OVERVIEW
Welcome to Scale & Soul! The terms “we”, “us” and “our” refer to Scale & Soul. Scale & Soul is a personal hobby collection showcase based in Perth, Western Australia. We are not a registered business and do not hold an ABN.
This store serves as a window into our private collection of hand-crafted scale model ships. Occasionally, pieces from our collection are made available to fellow enthusiasts.
The terms and conditions below (these “Terms of Service” or “Terms”) describe your rights and responsibilities when you browse or purchase from this store.
By visiting, interacting with or using our store, you agree to be bound by these Terms of Service. If you do not agree, please do not use or access our store.
Important — Nature of this store (revised wording)
Scale & Soul is a private collection showcase, not a commercial business. Transactions are private sales between individuals. While we are not a registered business, the Australian Consumer Law (ACL) consumer guarantees MAY STILL APPLY to the extent required by law. These Terms do not exclude any guarantee or remedy that cannot lawfully be excluded. The law against false or misleading conduct applies to all sales,
and we commit to honest and accurate descriptions.
SECTION 1 – NATURE OF THIS STORE
1.1 Scale & Soul is a personal hobby collection showcase. We do not operate as a registered business, do not hold an ABN, and are not registered for GST.
1.2 Items listed for sale are offered occasionally from our private collection. We do not engage in systematic marketing, regular restocking, or commercial-scale selling.
1.3 By purchasing from this store, you acknowledge that this is a private sale and not a commercial transaction. Nothing in these Terms excludes any statutory consumer guarantee or remedy that cannot lawfully be excluded.
SECTION 2 – OUR PRODUCTS
2.1 We make every effort to accurately describe and photograph each model. However, colours and appearance may vary slightly depending on your device screen and lighting conditions.
2.2 Each model is sold on an “as-is, where-is” basis, with the following guarantees:
We confirm clear ownership of the item.
The item is as described in the listing to the best of our knowledge.
Any custom / made-to-order model is produced to the specifications agreed at the time of order.
2.3 All descriptions are subject to change without notice. We reserve the right to remove any listing at any time.
SECTION 3 – ORDERS
3.1 When you place an order, you make an offer to purchase. We reserve the right to accept or decline any order at our sole discretion.
3.2 Your order is accepted only when we confirm acceptance by email. Payment must be received and processed before acceptance.
3.3 Cancellation is governed by our Refund & Returns Policy (see Section 6 and the Policy). In particular, custom / made-to-order models cannot be cancelled once production has commenced.Refund & Returns Policy
3.4 Items are offered for personal collection purposes. We reserve the right to refuse bulk or commercial orders at our discretion.
SECTION 4 – PRICES AND PAYMENT
4.1 Prices are displayed in Australian Dollars (AUD) and are exclusive of GST. We are not registered for GST.
4.2 For international orders (including to the United States), prices exclude import duties, taxes, customs clearance fees and any applicable sales tax. These are the buyer’s responsibility. See Section 8 for further details applying to US customers.
4.3 Payment must be made in full before shipment. We accept payment via the methods offered at checkout.
SECTION 5 – SHIPPING AND DELIVERY
5.1 Delivery times are estimates only. While we take reasonable care in packing and dispatch, we are not liable for shipping delays caused by carriers, customs, or events outside our control.
5.2 Risk of loss or damage passes to you once the item is handed to the carrier, subject to the remedies available under our Refund & Returns Policy (e.g. shipping damage claims). We recommend purchasing shipping insurance for high-value items.
5.3 For international shipments, the buyer assumes all customs-related risks and costs.
SECTION 6 – RETURNS AND REFUNDS
Section 6 revised — now references the Refund & Returns Policy as the single source of truth “All private sales are final” has been removed to avoid conflict with the Refund & Returns Policy. Returns, refunds and the 3-day / 12-hour timeframes are set out in that Policy only.
6.1 Returns and refunds are governed exclusively by our Refund & Returns Policy (the “Refund Policy”), which forms part of these Terms. In summary (for clarity only — the Refund Policy prevails):
In-Stock Models: change of mind is not accepted; remedies apply only as required by law or for a Major
Discrepancy (reported within 3 days of delivery).
Custom / Made-to-Order Models: cancellations are subject to the 12-hour window / production-start
rules in the Refund Policy; once production commences, such orders are non-refundable.
Shipping damage must be reported within 3 days with photographic evidence; we will assist with carrier
claims.
6.2 These remedies reflect the private nature of each sale and do not constitute a commercial warranty. Nothing in this section excludes any guarantee or remedy that cannot lawfully be excluded.
SECTION 7 – INTELLECTUAL PROPERTY
7.1 All content on this store – including text, images, logos, and designs – is owned by Scale & Soul or used with permission.
7.2 You may not reproduce, distribute, or use any content for commercial purposes without our prior written consent.
SECTION 8 – PRIVACY & DATA

Discloses collection of personal information and use of TikTok Pixel / cookies for analytics and advertising.
8.1 We collect personal information (such as name, email address, shipping address and payment details) only as needed to process your order and communicate with you.
8.2 We use analytics and advertising tools, including the TikTok Pixel and cookies, to understand how visitors use our store and to measure the performance of our marketing. These tools may collect information about your visit (such as pages viewed and actions taken).
8.3 Our handling of personal data is governed by our Privacy Policy, which is incorporated by reference. By using this store, you consent to the collection and use of your information as described in that Policy.Privacy Policy
8.4 If you are located in the United States, please note that your information may be processed or stored outside the US (including in Australia). We take reasonable steps to protect your information.
SECTION 9 – THIRD-PARTY LINKS
9.1 Our store may contain links to third-party websites (including TikTok and payment providers). We are not responsible for their content or practices.
SECTION 10 – PROHIBITED USES
10.1 You may not use this store for any unlawful purpose, to harass others, to transmit malware, or to interfere with the operation of the store.
SECTION 11 – DISCLAIMER OF WARRANTIES
11.1 This store and its listings are provided on an “as-is” and “as-available” basis, subject to any statutory guarantees that apply.
11.2 Nothing in these Terms excludes or limits liability for fraud, death or personal injury caused by negligence, or any liability that cannot be excluded by law.
SECTION 12 – LIMITATION OF LIABILITY
12.1 To the maximum extent permitted by law, Scale & Soul shall not be liable for any indirect, incidental, or consequential damages arising from your use of this store or any purchase made herein.
12.2 Our total liability for any claim shall not exceed the purchase price paid for the item in question.
SECTION 13 – INDEMNIFICATION
13.1 You agree to indemnify and hold Scale & Soul harmless from any claims arising from your breach of these Terms or your misuse of the store.
SECTION 14 – SEVERABILITY
14.1 If any provision of these Terms is found to be invalid, the remaining provisions shall remain in full force and effect.
SECTION 15 – WAIVER; ENTIRE AGREEMENT
15.1 Failure to enforce any right does not waive that right. These Terms, together with the Refund & Returns Policy and Privacy Policy, constitute the entire agreement between you and Scale & Soul regarding your use of this store.
SECTION 16 – GOVERNING LAW & DISPUTE RESOLUTION
16.1 For customers in Australia: these Terms are governed by the laws of the State of Western Australia and the Commonwealth of Australia, and the parties submit to the non-exclusive jurisdiction of the courts of Western Australia.
16.2 For customers in the United States (dispute resolution step): before commencing any court action, the parties agree to first seek resolution in good faith (including written notice to worldshipsmodel@outlook.com describing the dispute). If unresolved after 30 days, either party may submit the dispute to binding arbitration under the applicable commercial arbitration rules, conducted remotely where practicable. Nothing in this section limits any non-excludable statutory rights.
16.3 For all other customers: the governing law is the laws of the State of Western Australia, without regard to conflict of laws principles.
SECTION 17 – CHANGES TO TERMS
17.1 We may update these Terms at any time by posting the revised version on this page. Your continued use of the store after changes constitutes acceptance.
